Metalloinvest to take legal action over confiscation of its iron ore in Ukraine

Russianbased iron ore producer Metalloinvest will take legal action versus Ukraine and any possible purchaser if Kyiv seizes tens of countless dollars worth of the company's iron ore it seized in 2022, two sources told Reuters.

A Ukrainian court is because of hear on Sept. 19 a lawsuit filed by the country's justice ministry in July seeking to take the possessions of shareholders of Metalloinvest bulk owner USM Holding located on Ukrainian territory.

Ukrainian authorities confirmed in December 2022 the seizure of around 160,000 metric tons of Metalloinvest's iron ore, nine months after Russia sent countless its troops into the nation.

Ukraine's security service, the SBU, stated the ore was of Ukrainian origin and was kept in illegal storage in the country's ports and was predestined for Russia.

Its Economic Security Bureau stated that Metalloinvest was trying to ship the ore to Ukrainian-based firms to evade paying Ukrainian value-added tax.

Metalloinvest rejects all the accusations by Ukrainian authorities.

It states that the ore was produced in Russia and was shipped through Ukraine to global buyers prior to February 24, 2022, the day the war in Ukraine started, when it was seized by Ukrainian authorities, some in ports and some still on the train.

Documents seen reveal that the shipping route through Ukraine was used by the business to send iron ore to markets in Europe and Asia before the war.

Both sources close to the business said that Metalloinvest planned to protect its rights both in Ukrainian courts and worldwide, including through legal action versus Ukraine. Among the sources stated any possible buyer of the ore would face legal action.

A representative for Metalloinvest declined to comment

Ukraine's justice ministry informed Reuters it would not comment. on Metalloinvest's reported legal strategies.

Ukraine's Supreme Anti-Corruption Court hearing in September will rule on the fate of the ore. If the justice ministry wins its case, the planned difficulty by Metalloinvest would be the initially significant international legal action against a confiscation ruling by the court.

If the ore is seized, it would probably be offered to either domestic or international buyers. The court has since 2022 taken properties linked to several Russian entrepreneurs and officials, including billionaire Vladimir Yevtushenkov, a. creator of the Sistema telecoms-to-agriculture conglomerate.

Yevtushenkov has openly said that he no longer has any. properties in Ukraine.

Russian billionaire Alisher Usmanov utilized to manage USM however. has slowly reduced his share to below 50%.
